ANDREW T. MCKINNEY IV


Over a 42-year trial and appellate career, I have seen the best mediators in action and tried cases against many of the best lawyers in the state on both sides of the docket.  Over time, one learns a lot about mediation, particularly after taking an unfavorable verdict.  After roughly 140 trials (plaintiff and defense, but mostly defense) and 40-plus arguments to various Texas Courts of Appeals, the 5th Circuit, and the Texas Supreme Court, I am intimately familiar with the post-verdict feast or famine paradigm.  


My conclusion: the thrill of victory is roughly one-tenth of the agony of defeat. However, I do not ever recall losing sleep over a settlement.
